These are the terms & conditions of The Green Travel Company Ltd trading as 'Greener Travel'.
1.
THESE TERMS
1.1
These are the terms and conditions on which we supply products to you, whether these are goods, services or digital content.
1.2
Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.
1.3
Our Services are evolving, and hence we may update the Services and the Terms from time to time. If we modify the Terms, we’ll let you know either by posting the updated Terms on the Services or through other communications. It’s important that you review the Terms whenever we update them or when you use the Services. If you continue to use the Services after we have posted updated Terms, you are agreeing to be bound by the updated Terms. If you don’t agree to be bound by the updated Terms, then you may not use the Services anymore and you are prohibited from doing so. We may, at our sole discretion, change or discontinue all or any part of the offerings we provide via our Services, at any time and without notice.

You acknowledge that Greener Travel may establish general practices and limits concerning use of the Services, including the maximum period that data or other content will be retained by the Services and the maximum storage space that will be allotted on Greener Travel’s or its third-party service providers’ servers on your behalf. You agree that Greener Travel has no responsibility or liability for the deletion or failure to store any data or other content maintained or uploaded to the Services. You acknowledge that Greener Travel reserves the right to terminate or suspend accounts and credentials that are inactive for an extended period. You further acknowledge that Greener Travel reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.
2.
ABOUT THE SERVICES
2.1
Greener Travel’s Services allow you to find, compare, select, and purchase carbon credits, negative emissions, renewable energy credits, carbon removal credits, and similar assets quantified and tracked in the form of tonnes CO2e intended or anticipated to be avoided, reduced, or removed and issued as credits (“Credits”) from third-party negative emissions and carbon offset developers or registries (“projects”) Greener Travel facilitates that transactions and will provide you with the appropriate evidence of your purchase of Credits. Greener Travel serves as an intermediary between you and the applicable project. You acknowledge and agree that, in these transactions between you and our projects, Greener Travel is an intermediary, not acting as a seller or reseller of Credits, nor is Greener Travel a party to the transaction between you and the project. Greener Travel also provides API integrations which allow you to present offset estimates, project pricing, and Credit purchase opportunities to your end users within your own products or services, as well as checkout links which allow you to direct your users to the Greener Travel site where they can purchase Credits via the Greener Travel marketplace.
3.
WHO MAY USE THE SERVICES?
3.1
You may use the Services only if you are 18 years or older (or the legal age of majority in your jurisdiction), capable of forming a binding contract, and are not barred from using the Services under applicable law. If you want to use certain features of the Services, you’ll have to register for an account. It’s important that you provide us with accurate, complete, and up-to-date information for your Account and you agree to update such information to keep it accurate, complete and up-to-date.

If you don’t, we reserve the right to suspend or terminate your Account. You agree that you won’t disclose your Account password to anyone and you’ll notify us immediately of any unauthorized use of your Account. You’re responsible for all activities that occur under your Account, whether or not you know about them. Greener Travel reserves the right to disable any account user name, password, or other identifier, whether chosen by you or provided by us, at any time, in our sole discretion for any or no reason, including if, in our opinion, there has been a violation of any provision of these Terms or other posted policies, guidelines, or rules.

INFORMATION ABOUT US AND HOW TO CONTACT US

We are The Green Travel Company Ltd is the controller and responsible for your personal data collectively referred to as "Greener Travel", "we", "us" or "our" in this document. Our contact details are 43a High Street, Kirkcaldy, Scotland, KY1 1LL, registered in Scotland, company number SC777061.

If we have to contact you, we will do so in writing by email to you at the email address you provided to us in your order.
5.
YOUR ACCOUNT
5.1
As part of the registration or account creation process, you will create login credentials (“Greener Travel User ID”) by providing and validating an email address. You promise to provide us with accurate, complete, and updated registration information about yourself. You may not select as your Greener Travel User ID a name that you don’t have the right to use, or another person’s name with the intent to impersonate that person. You may not transfer your account to anyone else without our prior written permission.
6.
OUR CONTRACT WITH YOU
6.1
Our acceptance of your carbon purchase will take place when we confirm the order is completed and add the order to your transaction history, at which point a contract will come into existence between you and us.

6.2
If we are unable to accept your order, we will inform you of this and will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.

6.3
We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.
7.
OUR PRODUCTS
7.1
The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device's display of the colours accurately reflects the colour of the products. Your product may vary slightly from those images.

7.2
If we are making the product to measurements, you have given us you are responsible for ensuring that these measurements are correct. You can find information and tips on how to measure on our website or by contacting us.

8.
OUR RIGHT TO MAKE CHANGES
8.1
We may change the product to reflect changes in relevant laws and regulatory requirements and to implement minor technical adjustments and improvements. These changes will not affect your use of the product.

8.2
In addition, we may make changes to these terms or the product, but if we do so we will notify you and you may then contact us to end the contract before the changes take effect and receive a refund for any products paid for but not received.

9.
PURCHASES
9.1
If you purchase Credits through the Greener Travel platform, your payment amount (less the Order Management Fee) will be placed in an account and will be held by Greener Travel on your behalf and then retired by the owning registry. Once a credit is retired, the offsets have been applied and the credit is no longer live. Credits for whole tonnes purchased that are issued prior to when the Order Form is executed will be fulfilled within ninety days from the date of payment, or earlier. Credits for whole tonnes purchased, but not yet issued when the Order Form is executed will be fulfilled within ninety (90) days from date of payment or Credit issuance date, whichever is later. Credits for partial tonnes purchased require the remainder of the tonne to be purchased by Customer or another buyer, and therefore, will be fulfilled within ninety (90) days from date of payment for the full credit or Credit issuance date, whichever is later.
9.2
Upon receipt of the amount owed by Customer for a Credit purchase order, Greener Travel will reserve the appropriate allocation of Credits in Greener Travel’s system to prevent any double counting or out of stock events and provide a branded Greener Travel certificate of allocation that includes a summary of Credits that Customer has purchased and the associated fulfilment status of each of those Credits.
9.3
The full costs of each purchase will be as displayed to you on our website.
9.4
Delivery is electronic, and confirmation will be sent to your email address, and saved to your online account.
9.5
If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.
10.
PROJECTS
10.1
Greener Travel has and will continue to assess the methodological legitimacy of projects listed on its platform across multiple criteria. Greener Travel’s vetting process includes reviewing data and documentation provided by the projects, and typically includes 3rd party evaluations conducted by certain groups including but not limited to Verra, Gold Standard, Climate Action Reserve, and American Carbon Registry and UK Carbon Registry.
10.2
You acknowledge and agree that the availability of any given project or Credit within the Greener Travel Services is not an endorsement, recommendation, or sponsorship of such project or Credit by Greener Travel. You also acknowledge and agree that it is not possible for Greener Travel to verify the accuracy or completeness of all of the information that it obtains from or about projects. You acknowledge the possibility that: (a) Supplier partners may inadvertently or intentionally provide inaccurate information to Greener Travel about themselves, their projects, or the Credits that they are offering to make available through the Greener Travel Services; (b) Projects may inadvertently or intentionally omit relevant information to Greener Travel about themselves, their projects, or the Credits that they are offering to make available through the Greener Travel Services; (c) projects may be unable to create, transfer, or certify certain Credits despite their commitment to Greener Travel that such Credits would be created, transferred, or certified; (d) projects may experience business disruptions that cause them to be in breach of their agreements with Greener Travel or otherwise unable to provide or certify credits which they offered for sale through the Greener Travel platform, (e)similar errors, misrepresentations, omissions, negligence, or misconduct may occur on the part of projects which could cause them to be in breach of their agreements with Greener Travel or otherwise unable to provide or certify credits which they offered for sale through the Greener Travel Platform. You therefore agree that Greener Travel shall have no liability to you, for any actual, financial, emotional, monetary, or reputational harms, in such cases of project error, misrepresentation, omission, negligence, misconduct, or failure to fulfil their obligations to you or to Greener Travel. In the event that you need to seek legal recourse against a project, you may request Greener Travel’s assistance in resolving the dispute with the project prior to the commencement of any formal legal proceeding.
10.3
In some cases, a particular Credit purchased may not actually become available. This might be due to operational failure, financial circumstances of the project, delays that impact the vintage of the Credit, amongst other reasons. You acknowledge and agree that, in such cases, Greener Travel will notify you and request that you select an alternative Credit or a refund, and that you must respond to Greener Travel's notice within 10 days in order to exercise your choice, otherwise Greener Travel will select an alternative Credit for you. Greener Travel shall not be liable to you for any loss or damage incurred in the event where a particular Credit or project has become unavailable.
11.
YOUR RIGHTS TO CANCEL
11.1
For most products bought online you have a legal right to change your mind within 14 days and receive a refund. These rights, under the Consumer Contracts Regulations 2013, are explained in more detail in these terms.
11.2
If you cancel any carbon offset purchase with 14 days of purchase, you will receive a full refund.
11.3
If you decide to cancel a carbon offset purchase after 14 days, the carbon credits will have already been purchased on your behalf so you will not be refunded your payment, but the credits purchased will appear in your credit wallet and can will used in future offset purchases. The credits you hold in your wallet cannot be redeemed for cash values as they can only be used to against future travel emission offsetting purchases.
12.
HOW TO CANCEL
12.1
To cancel a purchase with us, please let us know by doing one of the following. Phone or email: Call customer services on at 03333443231 or by writing to us at email address support@greenertravel.co.uk Please provide your name, home address, details of the order and, where available, your phone number and email address.
12.2
We will make any refunds due to you back to the same card you made the purchase on. This process can take up to 5 workings days.
13.
OUR RIGHTS TO CANCEL
13.1
We may cancel the purchase at any time by writing to you if your payment fails or is you apply a charge back on your transaction.
13.2
If we cancel the purchase for any reason due to the lack of availability of project credits, we will refund any money you have paid in advance for credit offsets we have not provided.
14.
PRICE AND PAYMENT
14.1
The price of the carbon offset (which includes VAT) will be the price set out during the checkout process of your purchase. We take all reasonable care to ensure that the price of the product advised to you is correct. However please see clause 14.3 for what happens if we discover an error in the price of the offset you purchase.
14.2
If the rate of VAT changes between your order date and the date we supply the product, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect.
14.3
It is always possible that, despite our best efforts, some of the carbon projects we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the project's correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the project's correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and cancel any offsets we have made on your behalf.
14.4
We accept payment with all major credit cards. All payments for offsets are made in advance before your order will be processed.
15.
HOW WE MAY USE YOUR PERSONAL INFORMATION
15.1
We will only use your personal information as set out in our privacy policy.
15.2
We will only give your personal information to third parties where the law either requires or allows us to do so.
16.
LAW
16.1
These terms are governed by Scottish and English law, and you can bring legal proceedings in respect of the products in the Scottish/English courts. If you live in Scotland, you can bring legal proceedings in respect of the offsets in either the Scottish or the English courts. If you live in Northern Ireland, you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
16.1
Alternative dispute resolution is an optional process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court.
